Inspection and Compliance Information

ADVENTURE ACADEMY

The South Dakota Department of Social Services, Office of Licensing and Accreditation registers and licenses child care programs to ensure basic health and safety standards are met. Annual, unannounced inspections are conducted by Child Care Licensing Specialists and Department of Public Safety Inspectors. Inspections may also be conducted in response to a self-reported incident by the provider, a complaint from the public, or to monitor compliance. Following an inspection, a compliance plan is generated which details any issues of non-compliance found during the inspection and the agency action taken for each issue of non-compliance.

Inspection Reports, if applicable, and inspection results are posted within 60 days of the inspection, or 60 days of agency action on a founded complaint. The reports/results are available for viewing from the table below.

Definitions

Prior to reviewing an inspection report or results, please review the following list of definitions which will help you to further understand the inspection process and what you may see while reviewing documents below.

Date:
The date an on-site visit/contact was conducted, date CCS received a self-reported incident, or the date an agency action is issued on a founded complaint.

Type:

Facility Safety Inspection
Annual unannounced monitoring visit to ensure compliance with fire and life safety and environmental health standards for licensed child care programs are followed.
Program Inspection
Annual unannounced monitoring visit to ensure ratios, record keeping, program standards, etc. are met for licensed programs and to ensure the home environment for a registered family child care program meets minimum standards.
Complaint Inspection
Indicates non-compliance was determined as a result of a complaint.
Compliance monitoring
Indicates a non-compliance was noted as a result of an announced or unannounced visit. These visits are usually conducted to ensure issues as a result of an inspection or complaint are corrected and another unrelated issue is cited.
Self-reported incident
The Provider reports a non-compliance issue has occurred.

Agency Action:

Compliance Plan
is a standard form left with the Provider after a visit is completed. This provides notification to the Provider outlining the issues of non-compliance, which require correction and a time-frame in which correction is expected.
Corrective Action Plan
can be implemented as a result of a non-compliance citation not being completed in the originally agreed upon time-frame. A Corrective Action Plan can also be implemented as a result of elevated concerns having been determined to factor into non-compliance actions by the Provider or repeat history of non-compliance issues occurring within a relatively brief time period. Corrective Action Plans are typically 30-60 days in which the Provider must take action to change their practices or provide assurances regarding non-compliance issues. The Department will typically monitor the Provider for maintenance of compliance for a period of three months from the start of the Corrective Action Plan. Multiple Corrective Action Plans can be issued for varying issues of non-compliance for different periods of time.
Stipulation Consent Agreement
can be implemented as a result of continued non-compliance with licensing regulations and there has been little to no progress through the Corrective Action Plan process to achieve and maintain compliance. This agreement is entered into by the Provider with an understanding this action is in leu of a revocation of the registration or license to operate. This agreement may include specific restrictions in the provider operation tied to on-going non-compliance maintenance. Stipulation Consent Agreements are typically 6-12 months in which the Provider must take action to change and maintain practices and provide assurances regarding on-going compliance maintenance with child care licensing regulations. The Department will conduct additional inspections during the agreement period which are displayed on the DSS website.
Suspended
The department may temporarily suspend a registration or license if the health, safety, or welfare of the persons served by the child care program are in imminent danger or if the program is substantially out of compliance with the requirements.
Revoked
The department may revoke the license or registration certificate of any child care program if the applicant, licensee or registrant willfully or substantially fails to meet standards; violates any provisions of SDCL 26-6; furnishes or makes misleading or false statements; refuses to submit required documentation; refuses to submit to an investigation by the department; refuses to admit authorized personnel to the premises; fails to maintain a safe environment; fails to exercise care in hiring, training or supervision of staff; or fails to report child abuse or neglect.
Voluntary closure prior to correction
a Provider chooses to voluntarily close his/her registration or license instead of correcting the issue of non-compliance cited.

Status:

Pending
Indicates the Provider is working to correct the issue cited. All issues are monitored by the Department to ensure compliance is achieved.
Corrected
Provider has corrected the issue cited.
Corrected Immediately
Indicates the Provider corrected the non-compliance issue immediately, usually when the Department representative is on-site.
Founded
The department has determined that an issue of non-compliance was identified with the administrative rules or South Dakota laws that govern regulated child care.
